The Wall Street Journal delivered a strong rebuke of President Biden’s plans to modify the Supreme Court in an editorial published on Monday.
“Mr. Biden claims his reforms will ‘restore trust and accountability to the court and our democracy,’ but they would yield the opposite effect,” asserted the editorial board. “The flood of ethics complaints, magnified by media and partisan interests, would create a perception of widespread corruption, further eroding respect for the Court’s rulings.”
On the same day, Biden and Vice President Kamala Harris, the likely Democratic presidential candidate, endorsed sweeping changes for Congress to implement concerning the Supreme Court, such as term limits, ethics regulations, and a constitutional amendment to restrict presidential immunity.

“The President is using the full backing of the Democratic Party to launch an assault on judicial independence and the constitutional framework,” the Journal stated. “One might label it an attack on democracy.”
“The President is giving this proposal an official Democratic Party seal of approval, and Vice President Kamala Harris was quick to support the initiative on Monday,” the Journal added. “The most detrimental aspects pose a risk of passing whenever Democrats next control the government.”
The Wall Street Journal also specifically called out Sen. Sheldon Whitehouse, D-R.I., whose proposed ethics legislation regarding the Supreme Court has already secured passage through the Senate Judiciary Committee and “would allow litigants at the Court to file motions for recusal against Justices, who could then be removed from cases by their colleagues.”
“This would effectively make the Court a tool of the prevailing political climate at any moment,” the Journal argued. “The Justices most likely to face this scrutiny would be those issuing unpopular decisions, regardless of their correctness in law or constitutional interpretations.”

“And what of the Republicans?” the Journal inquired. “Are they aware that the Court’s future is a key issue in this year’s ballot? Mr. Trump has voiced his thoughts, but will Senators begin to articulate what is genuinely at stake? Perhaps JD Vance could shift focus from cat ladies and discuss the threat that the Biden proposal presents to the Court and our constitutional republic.”
